Marijuana Dispensary: Florida’s Cannabis Policy Updates for 2025
Cannabis Policy on the Agenda in Florida’s 2025 Legislative Session
Florida lawmakers are considering multiple cannabis reform bills in 2025, including:
- Expanding medical cannabis access
- Expungement of past cannabis convictions
- Adult-use cannabis legalization
🗳 In November 2024, 55.9% of Florida voters supported legalization—just short of the required 60% supermajority. Now is the time to urge legislators to respect voter demand and advance cannabis reform.
Medical Cannabis Expansion Bills
Several bills aim to improve Florida’s medical marijuana program, including:
✅ S0564 (Sen. Joe Gruters) – Would allow medical cannabis patients to grow up to two plants at home.
✅ S0552 (Sen. Gruters) – Includes:
- Telemedicine for cannabis recommendations
- Cannabis access for patients prescribed opioids
- Two-year validity for recommendations
- Fee waivers for honorably discharged veterans
- Increased product limits for patients
- Reciprocity for visiting patients from other medical cannabis states
🛡 Patient Protections
- S0146 / H0993 – Would prevent parents from being charged with child neglect or endangerment due to responsible medical cannabis use.
- S0142 / H0083 – Would protect public sector employees who are medical cannabis patients from job discrimination.
- 🚨 Law enforcement officers are excluded, but firefighters and EMS workers would be covered.
Expungement Reform for Cannabis Convictions
Tens of thousands of Floridians still carry criminal records for minor cannabis offenses. Proposed bills aim to change that:
🔹 S1026 – Would automatically expunge possession charges for up to two ounces of cannabis.
🔹 S1028 – Provides a comprehensive expungement framework, making past convictions confidential.
📢 Support Expungement! Criminal records limit access to jobs, housing, and education—tell lawmakers to clear cannabis-related charges.
Adult-Use Cannabis Legalization
🗳 2024 Ballot Initiative: Amendment 3 received 55.9% support, but fell short of the 60% required for passage.
🏛 Legislators have introduced multiple legalization bills, including:
- H0555, H1501, S1032, and S1390 – Would regulate and tax adult-use cannabis in Florida.
⚠️ If lawmakers fail to act, voters will get another chance in 2026. Smart and Safe Florida has already begun planning a 2026 ballot initiative to legalize cannabis.
Current Cannabis Laws in Florida
🚨 Florida still jails people for simple possession.
- 20 grams or less → Misdemeanor (up to 1 year in jail, $1,000 fine)
- More than 20 grams → Felony (up to 5 years in prison, $5,000 fine)
📊 In 2017, 42,153 people were arrested for cannabis possession in Florida. While arrest rates have dropped, thousands are still jailed each year.
Medical Cannabis in Florida
🩺 Legalized in 2016 via Amendment 2. Patients need:
- A qualifying condition
- Certification from a Florida doctor
- A medical marijuana ID card
Patients can purchase cannabis from licensed Medical Marijuana Treatment Centers (MMTCs).
