Governor Signs Cannabis Expungement Bill
In April 2023, Gov. Michelle Lujan Grisham signed HB 314 into law to streamline cannabis expungements. The law allows individuals to:
- Verify the status of their expungement.
- Request expedited processing for unresolved cases.
This addresses technical issues in the 2021 legalization law, which included automatic expungements and resentencing provisions.
$300 Million in Cannabis Sales in First Year
New Mexico’s adult-use cannabis market launched on April 1, 2022. In its first year, the state saw over $300 million in sales.
- New Mexico became the 18th state to legalize adult-use cannabis in 2021.
- Adults 21+ can possess up to two ounces and grow six mature plants.
Medical Cannabis Program Updates
New Mexico is one of 38 states allowing medical cannabis. In June 2019, the Department of Health added six new conditions, including:
- Opioid use disorder
- Alzheimer’s disease
- Autism spectrum disorder
The 2019 law (SB 406) also:
- Allowed reciprocity for visiting patients.
- Extended medical card renewals to every three years.
- Provided employment protections for medical cannabis patients.
In 2018, a court ruling overturned the 450-plant cap for nonprofit producers, increasing it to 2,500 plants to reduce supply shortages.
