Legal Status

Washington legalized recreational cannabis in 2012 (Initiative 502), with sales beginning in July 2014. The state operates a tightly regulated system.

Recreational Cannabis

Adults 21+ can legally purchase and possess cannabis from licensed retailers. Washington has a state-run licensing system with strict regulations on production, processing, and retail.

Medical Cannabis

Medical marijuana was legal from 1998-2016. The medical program was merged into the recreational system in 2016. Medical patients can register for tax exemptions and higher possession limits.

• 16 ounces of cannabis-infused product in solid form

• 48 ounces of cannabis-infused product in solid form
• 216 ounces of cannabis-infused product in liquid form

• Can grow up to 4 plants (if no licensed retailer within 25 miles)

Home Cultivation Prohibited

Home cultivation is illegal for recreational users in Washington. Only registered medical patients in areas without nearby dispensaries may grow.

Washington is one of the few recreational states that does not allow home growing for adult-use consumers. This policy is designed to maintain state control over the cannabis supply chain.

Medical Patient Exception

• Must be registered medical patient
• Only if no licensed retailer within 25 miles
• Maximum 4 plants (or 6 with authorization)
• Must be in secure, enclosed space

Public consumption is illegal and can result in a civil infraction with fines up to $100.

Driving & DUI Laws

Driving under the influence of cannabis is illegal. Washington has a 5 nanogram per milliliter THC blood limit.

• DUI penalties: Fines, license suspension, jail time
• First offense: Up to 364 days jail, $5,000 fine, 90-day license suspension
• Keep cannabis in trunk or sealed container while driving
• Passengers cannot consume in vehicle

Workplace & Employment

Employers in Washington can maintain drug-free workplace policies and take action against employees for cannabis use, even off-duty:

• Employers can prohibit cannabis use and test employees
• No employment protections for cannabis users
• Medical patients have no additional workplace protections
• Pre-employment and random drug testing allowed
• Termination for positive test is legal
